Welcome to Ratr (“we,” “our,” or “us”). These Terms of Service (“Terms”) govern your use of our mobile application and related services (collectively, the “Services”). By accessing or using Ratr, you agree to these Terms. If you do not agree, please do not use our services, or discontinue use immediately.

1. Eligibility

By using Ratr, you represent that you:

• Are at least 13 years old (or have parental consent if under 18).

• Have the legal capacity to enter into these Terms.

• Agree to comply with all applicable laws and regulations.

2. Account Registration

To access certain features, you may be required to create an account. You agree to:

• Provide accurate and complete information during registration.

• Maintain the confidentiality of your credentials.

• Notify us immediately of any unauthorized access or use of your account.

You are responsible for all activity under your account.

3. Use of the Services

3.1 Permitted Use

You may use Ratr for lawful purposes related to personal physique tracking and fitness monitoring.

3.2 Prohibited Use

You agree not to:

• Use the Services for any illegal or unauthorized purpose.

• Upload harmful, offensive, explicit, or inappropriate content.

• Attempt to reverse engineer, modify, or interfere with the Services.

• Use automated tools (e.g., bots or scripts) to interact with the app.

• Disrupt or compromise the security or performance of the Services.

4. Subscriptions and Purchases

4.1 Premium Features

Ratr offers paid subscription features. By purchasing, you agree to:

• Pay all applicable fees and taxes.

• Use authorized payment methods through Apple.

• Understand that subscription fees are non-refundable unless required by law.

4.2 Cancellations

You may cancel your subscription at any time through your Apple App Store account settings. Your subscription will remain active through the end of the current billing cycle.

5. Content and Intellectual Property

5.1 Ratr Content

All app content, including logos, graphics, UI, and software, belongs to Ratr or its licensors and is protected by intellectual property laws.

5.2 User Content (Photos, Data, and Materials)

• You retain full ownership of the photos and content you upload.

• Ratr does not use user photos for AI training, model improvement, or third-party analysis.

• You grant Ratr a limited, revocable license to store and process your photos solely for physique analysis and personal progress tracking.

5.3 Prohibited User Content

You may not upload content that:

• Violates laws or regulations.

• Contains explicit nudity, harassment, or offensive material.

• Infringes intellectual property or privacy rights.

6. Privacy and Data Use

Your use of Ratr is governed by our Privacy Policy. By using the Services, you consent to the collection, storage, and processing of your data as described therein.

7. Termination

We may suspend or terminate your account if:

• You violate these Terms.

• You misuse the Services.

• We suspect fraudulent or harmful activity.

Users may delete their accounts at any time through the app, which permanently deletes all associated data.

8. Limitation of Liability

To the fullest extent permitted by law:

• Ratr is provided “as is” and “as available.”

• We disclaim all warranties, express or implied.

• We are not liable for indirect, incidental, or consequential damages.

• Our total liability is limited to the amount you paid for the Services in the twelve months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless Ratr, its affiliates, employees, contractors, and partners from any claims arising from:

• Your use or misuse of the Services.

• Your violation of these Terms.

• Your infringement of third-party rights.

10. Changes to These Terms

We may update these Terms periodically. Updates take effect upon posting in the app. Continued use indicates acceptance of the changes.

11. Governing Law and Dispute Resolution

These Terms are governed by U.S. law and the laws of the State of Massachusetts. Disputes will be resolved through:

2. Binding arbitration, unless prohibited by law.

12. Additional Terms

12.1 Third-Party Services

Ratr integrates with third-party tools such as Supabase for storage and Apple for subscription processing. Each has its own terms and privacy obligations.

12.2 No Waiver

Failure to enforce any provision does not constitute a waiver.

12.3 Severability

If any section is deemed unenforceable, the remaining provisions remain in full effect.
